1. Introduction and Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Client", or "you") and ARANOVA ("we", "us", or "our") governing your access to and use of the Aprendly platform ("Platform" or "Service").
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Description of Service
Aprendly is a platform designed for the creation, management and automatic grading of interactive exercises, allowing teachers to design engaging learning activities and students to complete them interactively on any device, without the need for accounts or emails. The Platform provides digital asset inventory, trusted delegate designation, automated post-mortem instructions, legal verification protocols, and end-to-end encrypted vault storage.
3. Data Verification and Information Enrichment
ARANOVA may supplement the information provided by users with data obtained from publicly available sources for the following purposes:
- Identity verification: Confirming the accuracy of data provided and preventing fraudulent use of the Platform.
- Fraud prevention: Detecting and mitigating risks of fraudulent activities that may affect the security of the service and its users.
- Experience improvement: Adapting and personalising the service based on up-to-date and relevant information.
- Personalisation: Offering functionalities and content tailored to the user's profile based on verified data.
This processing is based on the legitimate interest of ARANOVA (Art. 6.1.f of the General Data Protection Regulation - GDPR), and is strictly limited to:
- Sources of information: Public databases (companies registries, official registers), authorised verification providers with GDPR-compliant Data Processing Agreements (DPAs), and publicly available information on professional platforms or official websites.
- Limitations: Only public data is consulted. Under no circumstances do we access private information, personal social media data, or any other source requiring the data subject's specific consent.
- Right to object: In accordance with Article 21 of the GDPR, you may object at any time to this processing by sending an email to info@aprendly.es with the subject "Objection to Data Enrichment". Exercising this right is free of charge and will not affect the provision of the contracted service.
4. User Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5. Intellectual Property
The Platform and its original content, features, and functionality are owned by ARANOVA and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
6. Limitation of Liability
In no event shall ARANOVA, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect.
